When a company closes down or has a director die it is much the same as the bereavement of a family member. In the case of a company the Will is a Shareholder Agreement or Partnership Agreement. These enable the continuation of the business on the death of an owner, shareholder or partner.
In the same way when an individual becomes incapacitated they often have a a family member stand in for them using a Lasting Power of Attorney. The same applies to a business as banks may require someone to stand in the incapacitated persons shoes using a Lasting Power of Attorney.
